Please read these Terms and Conditions carefully before using the services offered by Akazila Inc. through Alkanzo.
1. Introduction
Welcome to Alkanzo.ai(“Service”), a creative and video production product operated by Akazila Inc.(“Company”, “we”, “our”, “us”)!
These Terms of Service (“Terms”, “Terms of Service”) govern your use of our website located at alkanzo.com and alkanzo.ai and related apps (together or individually “Service”) provided by Akazila Inc.
Please read these Terms carefully which contain important information about your relationship with Akazila Inc., including mandatory arbitration of disputes between us, instead of class actions or jury trials; by using services offered by Akazila Inc. through Alkanzo websites and apps, you agree to be bound by them.
Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages and applications.
Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood Agreements, and agree to be bound by them.
If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing hello@app.alkanzo.ai so we can try to find a solution. These Terms apply to all visitors, users and others who wish to access or use Service.
2. Communications
By using our Service, you agree to subscribe to newsletters, marketing, or promotional materials, transactional emails and other information we may send via email. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing hello@app.alkanzo.ai.
3. Purchases
If you wish to purchase any product or service made available through Service (“Purchase”), including Creative Production credit packs, you may be asked to supply certain information relevant to your Purchase including but not limited to your credit or debit card number, the expiration date of your card, and your billing address.
You represent and warrant that: (i) you have the legal right to use any card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
We may employ the use of third party services (including Stripe) for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.
We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.
4. Credit Packs and Automatic Top-up
Some parts of Service are billed by purchasing Creative Production credit packs for a team. Team admins may also enable automatic top-up so that an additional credit pack is purchased when that team’s available Creative Production credits reach zero. Automatic top-up uses the credit pack level selected for the team and does not run if automatic top-up is disabled or if a monthly top-up budget you have set would be exceeded by the purchase.
A valid payment method is required to process payment for credit packs and automatic top-ups. You shall provide Akazila Inc. with accurate and complete billing information that may include but is not limited to full name, address, state, postal or zip code, telephone number, and a valid payment method. By submitting such payment information, you automatically authorize Akazila Inc. to charge applicable credit pack fees incurred through your account to any such payment instruments.
Should automatic billing fail to occur for any reason, Akazila Inc. reserves the right to terminate or suspend your access to paid features of the Service.
5. Fee Changes
Akazila Inc., in its sole discretion and at any time, may modify credit pack prices and related fees. Any fee change will become effective for subsequent purchases and automatic top-ups after we post the updated pricing.
Where practical, Akazila Inc. will provide you with reasonable prior notice of a material fee change. Your continued use of Service after a fee change comes into effect constitutes your agreement to pay the modified fees.
6. Credits System and Expiration
Credit Expiration Policy: Any Creative Production credits purchased, whether through manual purchase or automatic top-up, and allocated to any team and bundle expire 365 days after the date of the most recent credit top-up for that specific team and bundle. This 365-day expiration applies to all such credits, regardless of when they were originally purchased or assigned.
Expiration Reset Clarification: When any new credits are added to a specific team and bundle, whether through manual purchase or automatic top-up, the expiration period for all credits associated with that team and bundle resets. All existing and newly added credits for that team and bundle will then expire 365 days from the date of that new top-up, regardless of when any portion of those credits was originally purchased or assigned. Upon expiration, all remaining unused credits for that team and bundle will be automatically reduced to zero.
Credit Consumption: Credits are consumed when you initiate Creative Production operations such as story planning, video or image generation, reference-image processing, Kaaya creation, or other services provided through the Service. Credits consumed for operations performed based on user interactions with the website, application, or product cannot be refunded under any circumstances, regardless of whether the operation succeeds or fails, or whether the output meets your expectations or quality standards. You are solely responsible for ensuring you have sufficient credits before initiating any operation.
Non-Refundability of Consumed Credits and Purchased Funds: You expressly acknowledge and agree that:
a. Credits consumed for any operations performed cannot be refunded under any scenario, including but not limited to successful operations, failed operations, operations with unsatisfactory results, or operations that fail at any point due to errors on our side or third-party services.
b. You cannot hold the Company or services provided responsible for refunding consumed credits in any circumstance.
c. You cannot claim refunds for money spent on purchasing credits for any bundle, whether the credits have been partially consumed, fully consumed, or remain unused.
d. The Company is not liable to refund consumed credits or refund partial or full amounts of money spent by users for purchasing credits for any bundle. The Company disclaims all responsibility and liability for any claims related to refunds of consumed credits or money paid for purchasing credits.
e. By using the Service and consuming credits, you waive any right to claim refunds for consumed credits or amounts spent on purchasing credits.
f. Expired generated creative media is not eligible for a credit refund.
7. Content
Platform content found on or through this Service (excluding content you upload or generate) is the property of Akazila Inc. or used with permission. You may not distribute, modify, transmit, reuse, download, repost, copy, or use said platform content, whether in whole or in part, for commercial purposes or for personal gain, without express advance written permission from us.
You retain rights in content you upload (including reference images, drafts, and Team Drive files) and in outputs the Service generates for you, subject to these Terms, third-party model-provider terms, and applicable law. You are responsible for ensuring you have the rights to upload references (including likenesses) and to use generated outputs.
8. Prohibited Uses
You may use Service only for lawful purposes and in accordance with Terms. You agree not to use Service:
a. In any way that violates any applicable national or international law or regulation.
b. For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
c. To transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter,” “spam,” or any other similar solicitation.
d. To impersonate or attempt to impersonate Company, a Company employee, another user, or any other person or entity.
e. In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
Additionally, you agree not to:
a. Use Service in any manner that could disable, overburden, damage, or impair Service or interfere with any other party’s use of Service, including their ability to engage in real time activities through Service.
b. Use any robot, spider, or other automatic device, process, or means to access Service for any purpose, including monitoring or copying any of the material on Service.
c. Use any manual process to monitor or copy any of the material on Service or for any other unauthorized purpose without our prior written consent.
d. Introduce any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.
9. Analytics
We may use third-party Service Providers to monitor and analyze the use of our Service, including Google Tag Manager and Google Analytics.
10. Use By Minors
Our Service is available to people of all ages. However, if you are under the age of 18, you should review these Terms with your parent or guardian to make sure that you and your parent or guardian understand and agree to these Terms. Parents or legal guardians of minors are responsible for reviewing and monitoring their children’s use of our Service.
11. Accounts
When you create an account with us, you guarantee that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on Service.
You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service such as Firebase Authentication or an OAuth provider. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
12. Intellectual Property
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Akazila Inc. and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Akazila Inc.
13. Copyright Policy
We respect the intellectual property rights of others. It is our policy to respond to any claim that Content posted on Service infringes on the copyright or other intellectual property rights of any person or entity.
If you are a copyright owner, or authorized on behalf of one, and you believe that the copyrighted work has been copied in a way that constitutes copyright infringement, please submit your claim via email to hello@app.alkanzo.ai, with the subject line: “Copyright Infringement” and include in your claim a detailed description of the alleged infringement.
14. Data Retention Policy
We prioritize your privacy and data security. Generated creative media (image and video artifacts stored under a creation) is retained for 180 daysfrom the creation’s creation date (created_at). The Service records an expiry time (expires_at) 180 days after that date.
A daily cleanup job permanently deletes expired image and video artifacts under the creation folder. Deleted media includes part videos, full-video stitches, thumbnails, preceding-part tails, and non-Kaaya story-plan / layer-1 stills and other image or video files in that creation tree. Each media file is moved to Team Drive trash and then permanently deleted. Expiry is hard: there is no restore after 180 days, and there is no credit refund for expired media. Creation folders remain non-deletable in the Drive user interface.
Kaaya library reference images and uploads, and Kaaya-sourced story-plan reference stills, are notdeleted by the generated-creative expiry job. They follow Kaaya storage and renewal rules, including Creative Production credit billing for storage renewal on a cycle of twelve 30-day months from Kaaya creation. Drafts that never became a creation, and other users’ data, are not deleted by that job.
Any content you have downloaded or copied remains accessible to you and under your control. We remove expired generated media from our systems after the 180-day retention period. The Service does not currently offer a self-serve delete-account control that permanently erases all media.
15. Error Reporting and Feedback
You may provide us either directly at hello@app.alkanzo.aior via third party sites and tools with information and feedback concerning errors, suggestions for improvements, ideas, problems, complaints, and other matters related to our Service (“Feedback”). You acknowledge and agree that: (i) you shall not retain, acquire or assert any intellectual property right or other right, title or interest in or to the Feedback; (ii) Company may have development ideas similar to the Feedback; (iii) Feedback does not contain confidential information or proprietary information from you or any third party; and (iv) Company is not under any obligation of confidentiality with respect to the Feedback.
16. Limitation of Liability
In no event shall Akazila Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
17. Disclaimer
Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
Akazila Inc. its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements, including the quality, legality, or fitness of AI-generated video or images.
18. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
19. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
